A Faster Process With a Higher Bar
The Uniform Rapid Suspension (URS) system was designed as a faster, lower-cost companion to UDRP for clear-cut cases of infringement, available for new gTLDs. It does not transfer the domain — only suspends it — but it also requires the complainant to meet a higher "clear and convincing evidence" standard rather than UDRP's preponderance-of-the-evidence standard, which changes how much documentary support a filing needs before it is even worth pursuing.
When URS Fits, and When It Doesn't
Because of the higher evidentiary bar and the narrower remedy, URS is best suited to unambiguous cases with strong documentary evidence already in hand, rather than matters that depend on inference or a close reading of circumstantial facts. Part of an early case assessment is determining whether a matter is better suited to URS, full UDRP, or ACPA litigation given the evidence actually available.
